 In its brief, DEA contends that the scientific studies
 needed to establish marijuana's therapeutic efficacy as an
 antiemetic have not been conducted and that marijuana is not
 accepted by the medical community as a treatment for emesis®
 Both contentions are meritless.
 Xn its initial brief0 ACT offered overwhelming
 evidence demonstrating marijuanaSs medical utility, and
 acceptance by the medical community and society in general as an
 antiemetic. 9-_/ Using an irrational standard and meritless
 ...... arguments, DEA disregards this vast body of data, characterizing
 it as unreliable. The Agency concludes that, at best, the data
 demonstrates only that marijuana may have a #potential" use in
 treatment as an antiemetic.
 In defiance of the _ decision, DEA then
 pretends that the whole issue of marijuanaes accepted medical use
 as an antiemetic is _overned by efficacy-based, double-blind,
 randomized research studies involving statistically significant
 populations to demonstrate that marijuana is the #most effective _
 antiemetic. As already discussed, _2/P/_ in Section If, this
 proposed interpretation of _accepted medical use in treatment _ _
 an invalid_reading of Congressional intent.
