 As counsel for petitioner Alliance for Cannabis
 Therapeutics ("ACT") in the above-referenced matter, I am writing
 to express my serious concern regarding the apparent intent of
 the Department of Justice to file a brief In opposition te ACT_m
 petition f_r review_ which brief i_ due tomorzow, May 27. Xt is
 my sincere hope that you will in_el_vene in this matter and avoid
 any further legal or policy e:_.:or by the Department concerning
 this critical issue in the treatment of the seriously illo
 This case involves a petition by ACT and others tO
 reschedule marijuana from Schedule _ to Schedule II of the
 Controlled substances Acts 21 U,S,C. § 801 _ ___. Such a
 reacheduling would remove certain significant obstacles to
 mariJuana's use in treatment and research. This matter has been
 pending before the DEA and the D,C. Circuit since 1972; the DEA's
 unwavering opposition to the drug's rescA%edul_ng ha_ been
 criticized by the D.C. Circuit in four separate epinlons.
 More recently_ in 1988_ after extensive evidentia_y
 hearings, the chief A_m_n_trative Law Judge of the DEA found"
 that marijuana should be transferred to Schedule _. However_
 disregarding this ruling and the overwhelming record evidence Of
 marijuana_e medical effectiveness, in 1989_ the Administrator of
 the DEA refused to follow the AIJ_ find_ngls_ This ruling was.
 ori%!cized by the D.c. Circuit in 1991 a_ contrary to law and wee
